Terms and Conditions

The Terms and Conditions apply to all purchases made through the Govella website. By purchasing our products, you agree to comply with these Terms and Conditions and our Privacy Policy.

Govella’s products are intended strictly for personal, non-commercial use. We reserve the right to refuse orders from individuals acting outside of consumer use or those not complying with these Terms and Conditions.

Little about Govella

Govella owns and operates this website. The terms “we,” “us,” and “our” refer to Govella throughout the site. Govella is a company registered in the United Kingdom, with registration number … and a registered office located at …

Purchase our products

To purchase our products, you must:

  • Review the terms and conditions;

  • Fill the details with your name, address, phone number, email address, payment details, and any other necessary information;

  • supply a valid delivery address within Great Britain or Northern Ireland;

  • be the owner or authorized user of a valid debit/credit card, Apple Pay account, or another accepted payment method listed on the Govella website.

To place an order, simply click "ADD TO BAG" and proceed to the checkout page.

On the checkout page, you’ll have the chance to review your order(s), read and accept our Terms and Conditions, verify the total price, and review the information you’ve provided. You can also correct any errors before finalizing your order(s).

Please double-check and confirm that your delivery address is accurate before placing your order, as changes may not be possible once the order is prepared for dispatch. The Govella website currently ships to addresses within Great Britain and Northern Ireland and internationally. Govella makes reasonable efforts to ensure product availability for orders placed on our site. However, products are offered on a “first come, first served” basis and are subject to availability while stocks last.

Agreement & Sales Order Processing

After submitting your order (s), you will receive an email confirming receipt of your order/s -"Order Receipt Confirmation", along with the details of the products ordered.

Govella reserves the right to decline any order at its sole discretion and may not always be able to accept your order. For instance, this may occur in cases of pricing errors, low stock, unusually large or suspicious orders, or if there are unforeseen circumstances beyond our control that prevent us from fulfilling your order. If we are unable to accept your order, Govella will notify you by email, and any payment already made will be fully refunded.

Once your order is received, Govella will verify the availability of the product(s) in stock. A sales contract between you and Govella, governed by these Terms and Conditions, will only be established when Govella sends you an email confirming that the product(s) are available and have been dispatched ("Shipment Confirmation").

The contract is established when Govella sends the Shipment Confirmation to the email address provided with your order. If you do not receive this confirmation within 72 hours, please contact us. The contract covers only the products confirmed in the Shipment Confirmation; Govella is not obligated to supply any other products in your order until they are confirmed in a separate Shipment Confirmation.

If you wish to modify or cancel your order before receiving your Shipment Confirmation, please contact us as soon as possible. Please note that due to the rapid processing of orders, it may not always be possible to amend or cancel your order or to halt the dispatch of the products.

If Govella is unable to modify or cancel your order and the products have been dispatched, you have the option to either refuse the delivery, which will result in the products being sent back to Govella, or accept the delivery and then return the products as outlined in the “Returns & Refunds” section. After you receive your Shipment Confirmation, the dispatch process cannot be stopped.

Pricing, Shipping & Handling, Fees & Taxes

All prices are shown in Great British Pound Sterling (GBP). The price at the time of your order will apply and will be displayed at checkout, in the Order Receipt Confirmation, and the Shipment Confirmation.

If there is a pricing error on the Govella website or in your Order Receipt Confirmation, Govella may correct the price or cancel the order. If the correct price is higher, you’ll be notified and can choose to proceed or cancel. If you don’t respond, your order will be cancelled and refunded. If you decide not to continue, your sole option is to cancel. You acknowledge that even after Govella has sent you the Shipment Confirmation if the pricing error is clear and could reasonably have been recognized by you as a mistake, Govella is not obligated to provide the relevant product(s) at the incorrect price.

All products come with a VAT inclusive of the price except shipping.

Product and shipping prices may change at any time, but changes generally won’t affect orders with an issued Shipment Confirmation, except in cases of a clear pricing error as noted earlier.

Payment

Payment must be made using one of the methods available at checkout (VISA, MasterCard, Maestro, PayPal). Accepted payment types are listed on the Govella website during checkout. If authorization isn’t received from your card or payment provider, Govella reserves the right to decline your order.

For most payment methods, the total, including taxes and shipping fees, will be charged once you receive the Shipment Confirmation. Ownership of the products transfers to you once Govella receives full payment, including all applicable charges, and responsibility for the products begins upon delivery.

Delivery

Please allow up to 3 days for standard delivery (excluding Sundays and bank holidays) and up to 1 business day for next-day delivery (orders placed by 6 PM, excluding Sundays and bank holidays).

If delivery cannot be completed within the timeframe in your Shipment Confirmation, we will inform you, and you may cancel for a full refund. If you do not cancel, we’ll aim to deliver within a reasonable period.

If you delay accepting the delivery, or if an incorrect address results in a failed delivery, the package will return to Govella, your order will be cancelled, and a full refund issued.

Personalized Messages

When buying gifts, you can add a personal message for the recipient, which will accompany the product upon delivery. You are solely responsible for the content of this message. Govella reserves the right to reject any message and may cancel your order with a refund if the message is considered defamatory, offensive, obscene, abusive, threatening, discriminatory, inflammatory, harmful, explicit, deceptive, infringing on intellectual property, or otherwise unlawful. You cannot cancel your order if we decide not to include the message.

External Factors Beyond Govella's Control

Govella will not be liable for any delay or failure to perform if such delay or failure is due to circumstances beyond its reasonable control. This includes acts, events, omissions, accidents, or situations such as strikes or lockouts, non-performance by suppliers, power outages, shipping and transportation issues, communication or transportation facility failures, state emergencies, riots, invasions, storms, floods, epidemics, other natural disasters, and any government decrees, legislation, or restrictions.

In such situations, Govella will promptly notify you and take all necessary measures to minimize any delays. The timeframe for Govella’s obligations will be extended for the duration of these circumstances. If Govella cannot fulfil your order due to factors beyond its control, or if there is a considerable delay in delivery, you have the right to cancel your order and receive a full refund.

If feedback violates our terms, we may issue a formal warning, restrict your access to Govella’s platforms, contact you directly, or take legal action, including reporting to law enforcement.

Return & Refund

Cancellations under Consumer Contracts Regulations

Under the Consumer Contracts Regulations 2013 (CCR), customers may cancel their purchase from the Govella Website within 14 days of receiving non-sale items. If the product has been dispatched, it must be returned within 14 days of cancellation. Govella offers a free returns process with valid proof of purchase; otherwise, return shipping costs are the customer’s responsibility.

To return a product, please include your name, email address, order number, and order date for easy identification. For cancellations under the CCR, Govella will refund the full price, including VAT and standard delivery costs. Refunds may take up to 14 working days after confirmation. If you do not receive the ordered product, you are eligible for a refund once you notify Govella of your cancellation decision.

Govella cancellation policy for returns

In addition to your rights under the CCR, if you are not fully satisfied with your purchase, you may return any non-sale item within 14 days of receipt with valid proof of purchase for a refund. Once your return is received and verified, you will receive an email confirming refund eligibility. Govella’s policies do not affect your legal rights, including those under the CCR and the Consumer Rights Act 2015 for returning faulty items.

Faulty Products

If you need to return a product because it is faulty or not as described, and the return deadline has passed, please contact the Govella team. After returning your items as instructed and receiving approval for your refund, Govella will fully refund the price of the faulty or misdescribed products (including sale items), along with all applicable delivery charges and reasonable return shipping costs.

Exchange products

If you want to exchange your purchase for a different product or style, please follow our returns process and place a new order. When returning items for an exchange, only send back the products and the jewellery box they came in; do not return any additional gift packaging (like bags or gift notes), as we won’t send replacements for those.

Please note that stockists may have exchange policies that differ from Govella's, so contact them directly for details. Govella reserves the right to deny a refund if you do not return a product, or if a product sent by post does not arrive and you cannot provide it.

Products must be returned in new, unworn, and saleable condition for a refund or exchange. Govella may refuse a refund or exchange if the product is damaged or shows signs of use, or it may reduce the refund amount based on the item's diminished value due to improper handling.

If Govella refunds you before inspecting the product and later finds damage, you will be responsible for reimbursing the appropriate amount. Delivery costs for returns or exchanges under our enhanced cancellation policy will not be refunded.

Returning Products Purchased with a Promotion

To return products bought with a promotional offer, you may need to return any gifts received as part of the promotion or, in the case of a multi-buy offer, return the other items included in that offer. Valid proof of purchase is required for all returns.

Method of Refund Payment

Any refunds owed to you under these Terms and Conditions will be issued to your original payment method.

Data protection principles

Bmita Ltd (Govella Trade mark) is committed to processing data by its responsibilities under the GDPR.

Govella prioritises customer privacy and acknowledges the importance of protecting the information collected about them. Govella implements measures to ensure that personal data is processed securely and remains trustworthy.

The Privacy Policy explains how Govella collects, stores, uses, and discloses the data and information when accessing Govella’s website and making purchases. Additionally, Govella utilises information from customers and interactions with third parties to ensure a high level of quality in its products and services.

1. Who controls customers' data?

Govella is the data controller, which means it decides how the data is processed and for what purposes. As the data controller, it has legal responsibility for handling the information. If customers have any questions about how the data is processed or if customers want to exercise its rights, please contact Govella.

2. How Govella Process Data

Our practices are guided by strict ethical standards and legal requirements, and we are dedicated to protecting the privacy of all customers and website guests. For this reason, how we collect and store information, including personal data, depends on how our website and related services are used. We do not collect sensitive personal data about our customers.

Below, you’ll find an overview of the different ways Govella may process the data.

Data Collection Through Your Interactions with Us

To enhance, secure, and improve your experience on our website, email, and advertising services, we use various technologies that may automatically collect personal data, either directly by us or by third parties acting on our behalf. At the moment, no third parties are in partnership with Govella.

These technologies, such as cookies and server communications, allow us to gather data in a streamlined way. While providing personal data for these purposes is not a contractual requirement, opting out of these technologies may limit some features on the Govella website, potentially affecting your browsing experience.

When customers visit the website, the data may be processed for marketing and personalization purposes through web analytics, which could include A/B testing, analysis of product browsing, traffic sources, internal searches, device usage, and retargeting via cookies and similar tracking tools.

Use of Retargeting Technologies

We utilise retargeting technologies to display personalised ads to visitors who have previously shown interest in our products or brand through interactions on our website. These technologies analyse prior activity on our site to create a unique advertising profile, enabling us to deliver tailored ads across the internet. Our advertising partners may also display ads on our behalf across other websites. These partners may collect data about your visits not only to our site but also to other websites affiliated with the same advertising networks. At the moment, no third parties are in partnership with Govella

Social Media Partners

Our website may connect with various social networks that you use. For instance, customers can choose “social media login” as an authentication method for your Govella account. By using this login method, customers agree that we may receive the account details from the social network provider, enabling access to Govella accounts. If customers prefer not to share this data, they can create an account directly with its personal email, in which case no data from the social network will be shared with us.

We may also work with social networks to collect data about you to evaluate ad and campaign effectiveness, build targeted advertising audiences, improve ad reach, and deliver personalised content. Data collection occurs through pixel or similar technology and may include details such as your web browser type, online identifiers like IP address, and your interactions on our website (e.g., making a purchase, browsing products, or signing up for newsletters or SMS updates). Please refer to the list below to understand how each social network partner processes personal data.

Behavioural Web Data

When customers browse our website, their browser sends data to our server. If customers have enabled cookies and web analytics, this data helps us to enhance our services and improve the experience on our site and applications. This data is automatically gathered through third parties working on our behalf.

Behavioural web data may include details on customers' browsing behaviour, such as how each navigates our website, the date and time of the visit, and the referring site. It may also capture system preferences and device information, like each customer's browser type and IP address.

If cookies are not enabled, we will only collect the IP address and information on the browser customers are using.

Geolocation Data

When using this service, the map provider may access information about customers' location, such as GPS signals from a mobile device or other location-based data. This can manage location-sharing preferences in the device or browser settings.

Additionally, we may use an approximation of customers' location to understand geographic segments within our customer base. This occurs when opening an email from Govella, at which point the customer's IP address is matched with general latitude and longitude data. Note that this does not involve GPS tracking or ongoing location monitoring.

My Govella

To simplify the creation of My Govella account and eliminate the need to re-enter your information, we can use the data customers provided during a guest online order. This allows each customer to set the password after the order process.

If customers choose not to create a password at that time, customers purchase information will be stored for 30 days.

Direct Marketing

With customers' consent, we may reach out directly using the contact information provided (such as through mail, email, text messages, phone calls, QR codes, or other electronic means) for marketing and advertising purposes. This includes sending newsletters, SMS, personalised offers, and conducting market analysis.

Receiving marketing communications from Govella is optional and not a requirement for our services. If customers prefer not to receive these messages, they will not get newsletter emails or SMS alerts, although will still receive service-related emails regarding My Govella account.

Our processing of the data for direct marketing is based on customers consent as per GDPR Article 6 (1)(a). Customers can withdraw the consent at any time, but this will not affect the legality of any processing conducted before the withdrawal.

The personal data we process for direct marketing may include but is not limited to, customers contact details, general interactions with Govella (such as shopping behaviour and interests online, date of birth, loyalty program participation, product reviews, responses to electronic marketing, online behaviour, subscription to marketing materials, and engagement in campaigns or events).

Providing the contact details is essential for us to deliver the services customers are requestiong. Without this information, completing a purchase on the Govella website is not feasible.

The processing of the data is vital for fulfilling our contractual obligations to customers or addressing each queries before agreeing, per GDPR Article 6 (1)(b).
